This Privacy Policy applies to all individuals who access Car Clouds, LLC (“Company”) website at car-clouds.com (the “Website”) as well as our newsletters, social media sites or programs and other communication services provided on or through the Internet (the “Products”). By using the Company’s Website, you consent to the Company’s collection and use of your information as described in this Privacy Policy.

The Company may update this Privacy Policy from time to time. The effective date of the current Privacy Policy is noted at the top of this page. If the Company makes any material changes to the way it collects, uses, shares or processes the information that you have provided, the Company will notify you by posting a notice of the changes in a clear and conspicuous manner on our website. To the extent required by applicable data protection laws, Company will obtain your consent to any material Privacy Policy changes.

1. Information Company May Collect 

When you use the Website, the Company collects personal information about your use of the Website and information that you send through the Website. Throughout this policy, the Company uses the term "personal information" to describe information that identifies you or makes you identifiable. Information that has been anonymized so that it does not identify a specific individual is not “personal information.”

The Company may collect information that you voluntarily provide through the Website, including but not limited to, when you communicate via email or other channels with the Company and when you respond to communications or requests for information.  The information you provide may include your name and contact information. The Company only collects the personal information it needs to allow to respond to your request and/or provide the particular service you have sought. Without your personal information, the Company cannot respond to you or ensure your continued use and enjoyment of the Products. 

Unless specifically requested and you use the method that we identify for such purpose, the Company  requests that you not send us any confidential or sensitive information. 

2. How and Why Company Uses Your Information

Company uses your personal information to respond to your request and/or provide the particular service you have sought. Specifically, Company uses the collected personal information as follows: 

  • To post testimonials. We may post testimonials that may contain personal information. Prior to posting a testimonial, Company will obtain your consent to use your name and the content of the testimonial. If you wish to update, or delete your testimonial, please contact Company at info@car-clouds.com and include your name, testimonial location, and contact information.
  • To request feedback and to contact you about Company’s Products.
  • To enable user-to-user communications with each user’s consent.
  • To send administrative information to you, including product, service and new feature information and/or information about changes to Company’s terms, conditions, and policies.
  • To enforce our terms, conditions and policies and to comply with legal and regulatory requirements.
  • To respond to legal requests and prevent harm. If Company receives a subpoena or other legal request, Company may need to inspect the data it holds to determine how to respond.
  • To deliver requested Products.
  • To respond to your inquiries and requests and offer support related to the use of Company’s Products.
  • To send you marketing and promotional communications in accordance with your marketing preferences. You can opt-out of our marketing emails at any time.
  • To deliver targeted advertising to you. 

The Company may also use your personal information to actively monitor, investigate, prevent and mitigate any alleged or actual prohibited, illicit or illegal activities on or through the Website; investigate, prevent, or mitigate violations of the Company’s terms, agreements or policies; and enforce the Company’s agreements with third parties and partners. The Company cannot provide its Products in accordance with its terms, agreements or policies without processing your personal information for such purposes.

The Company is committed to ensuring your safety and continued enjoyment of its Products. To do so, the Company uses your personal information to combat spam, malware, malicious activities or security risks and to improve and enforce security measures. The Company cannot ensure the security of its Products if it does not process your personal information for security purposes.

When you provide personal information through the Website, the Company implies that you consent to its collection and use for that specific reason only.

If the Company asks for your personal information for a secondary reason, like marketing, the Company will ask you directly for your expressed consent.

4. Information Sharing

The Company does not sell, exchange, transfer, or give your information to any other company or individual for any reason except as set forth below:

Our Service Providers. With your consent only, the Company shares information with the following service providers, suppliers, subcontractors, and similar third parties who provide services to Company, or act on Company’s our behalf so that they can assist us with the maintenance of Company’s Products:

  • Shopify: Hosts and maintains the Website. 
  • Upwork: Provides order fulfillment and product management

The Company’s contracts with these service providers prohibit them from using or sharing with others, for other purposes than as directed by Company, the information that Company provides to them, or that they collect directly from Company’s users.

Reorganization. The Company transfer information to a third party in case of the reorganization, sale, merger, joint venture, assignment, transfer or other disposition of all or any portion of our business, asset or stocks, including in the event of corporate restructuring. The Company reserves the right, as part of this transaction, to transfer or assign information it has collected from users of the Products to these third parties. Except as otherwise provided by a bankruptcy or other court, the use and disclosure of all transferred user information will be subject to policies that are consistent with the policies described in this Privacy Policy. However, any information that a user submits or that is collected after that transfer may be subject to a new privacy policy adopted by the successor entity.

Law Enforcement Requests. The Company may use, share, or disclose information about users in order to address legal concerns or liabilities, especially when it believes, in its sole discretion, that (a) a user has misused the Products such as to gain unauthorized access to any system, engaged in spamming, denial of service attacks, or similar attack; (b) disclosure is reasonably necessary to (i) enforce Company’s Terms and Conditions of Service and/or (ii) to respond to suspected illegal or fraudulent activity; (c) to protect legal rights or defend against legal claims; (d) to allow Company to pursue available remedies or limit the damages that it may sustain.

Your Consent. The Company will disclose your information to a person or entity for which disclosure you have given us your consent.

5. Links to Third Party Services

Company’s Products may include links to third party services where you might be able to post comments, reviews, or view third party information. The use of these third party services may result in the collection and sharing of information about you by these third party services.

This Privacy Policy does not address the information practices of any third party. The inclusion of a third party link on the Website does not imply endorsement of the third party’s data handling practices, and does not imply that the third party’s practices are covered by this Privacy Policy. The Company is not responsible for the privacy practices of these entities.

6. Data

The Website is hosted on Shopify. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

7. Cookies

The following cookies are used on the Website: Google Analytics to measure how users interact with Website content.

The Company has listed the cookies used on the Website so you that you can choose if you want to opt-out of cookies or not.

8. How We Keep Your Information Secure

The Company uses reasonable measures to protect user information against unauthorized or unlawful access or processing, and against accidental loss, destruction, or damage. Even though the Company makes reasonable efforts to protect information in its custody, no data storage or transmission over the Internet and no security system is fully secure. Thus, the Company cannot guarantee the security of any information the Company may have collected or received from you or transmitted to you. You should only access the Products within a secure environment.

9. Retention

The Company retains information about users for as long as necessary to perform the activities described in this Privacy Policy, or where Company has an ongoing legitimate business need to do so, such as for legal, regulatory, accounting or reporting requirements.

When Company’s legitimate interest for retaining your personal information ceases to exist, Company will delete your information. To the extent residual information remains within Company’s databases, back-ups or other records and Company is unable to anonymize it, Company will isolate such information from further processing until deletion is possible. 

10. Children’s Information

Company does not knowingly collect any personal information from children under 18. If Company becomes aware that an individual under 18 is submitting information, Company will delete the information as soon as possible from its database.

11. California Privacy Rights 

California Civil Code section 1798.83 allows individuals who are California residents that have provided their personal information to the Company to request certain information about the Company’s disclosures of certain categories of personal information (if any) to third parties for their direct marketing purposes during the immediately preceding year. 12. European Residents Privacy Rights

If you are a resident of the European Union and you believe that the Company is unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority.
